Title: IN3 - Auto Liability Settlement - Brian Horn 134399

Recommendation:
I recommend that the School Board approve the Auto Liability  claim of Brian Horn, 134399 in the amount of $77,500 representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Description:

The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

An  18-year-old  student sustained knee injuries when he was struck by our bus on 9/28/01 which turned left in front of his vehicle. His vehicle sustained over $4,400 in damages.  The accident review committee found the accident preventable.

The right knee injury resulted in surgery with medical bills  in excess of $30,000.  He could no longer play football and lost the ability  to apply for a football scholarship.  His Coach indicated it was likely that he would have received one.

 The claim settlement, in the amount of $77,500, will extinguish all future liabilities.

Financial Impact:
The financial net impact to the District for this settlement is $77,500.  The source of funds is the General Fund.
