Title: M1 Jupiter Farms Elementary School - Proposed Department of Health Settlement

Recommendation:
I recommend the School Board approve the Proposed Settlement with the Department of Health in the amount of $4,250.00 for the water system facilities at Jupiter Farms Elementary School and approve the appropriate contracts.

Description: The Florida Department of Health has fined the School District for failure to properly maintain membranes in the water softening system at Jupiter Farms Elementary School.  The District has contracted the maintenance of the water system to Severn Trent - Avatar Utility Services, LLC.  Subsequently, all corrective actions required to bring the facility into compliance have been completed as agreed in a meeting with a Health Department representative.  The Health Department assessed a civil penalty in the amount of $4,250.00 due to the failure by the contractor to provide the required general monitoring of the water system. The contractor has taken responsibility for this lapse in the required procedures and they have provided a cashier's check in the amount of $4,250.00 to pay the penalties.

The financial impact to the project's budget is $0.00.
