Title: IN2 General Liability /JC 685764 Recommendation:
I recommend that the School Board approve the General Liability claim #685764 in the amount of $70,000 representing compensation, attorneys' fees and costs and authorize the execution of all related documents. This settlement will finalize all outstanding issues.
Description: The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.
A student, now 19, was allegedly injured while practicing with the football team on a PE field that was allegedly in poor condition and poorly maintained. Injuries include a torn cruciate ligament tear of the left knee, multiple surgeries and medical bills in excess of $42,000.
This is a negotiated settlement of $70,000 against a demand of $250,000.
The settlement will extinguish all future liabilities.
Financial Impact:
The financial impact to the District for this settlement is $175,000. The source of funds is the General Fund.
