Title: CS4 First Amendment to Agreement with Palm Beach Military Charter School Recommendation:
I recommend that the School Board approve the First Amendment to the Agreement with Palm Beach Military Academy Charter School to defer the opening of the Charter School to January 1, 2006.
Description: The School Board of Palm Beach County, Florida, ("School Board") and the Palm Beach Military Charter School, ("Charter School"), entered into an Agreement on April 21, 2005.
On June 29, 2005, the School Board received written correspondence from the Charter School, a copy of which is attached as Exhibit "A" to this Amendment, requesting that its opening date be deferred until January 1, 2006.
The request was based upon the fact that a facility would not be available until that date.
There are certain provisions in the Charter Agreement that need to be extended based on the deferred opening date. Those provisions are outlined in the First Amendment.
In the event of any conflict between the terms of the First Amendment and the Charter Agreement, the terms of the First Amendment shall control.
The Superintendent is authorized to take administrative action on delayed or deferred openings of Charter Schools.
Financial Impact:
There is no financial impact to the District.
