Title: CS7 Third Amendment to Agreement with Boca Raton Charter School Recommendation:
I recommend that the School Board approve the Third Amendment to the Agreement with Boca Raton Charter School, Inc. to defer the opening of the Charter School to January 1, 2006.
Description: The School Board of Palm Beach County, Florida, ("School Board") and the Boca Raton Charter School, ("Charter School"), entered into an Agreement on April 12, 2004. On May 14, 2004, the Charter School was approved by the School Board to defer their opening to August, 2005.
On July 7, 2005, the School Board received written correspondence from the Charter School, a copy of which is attached as Exhibit "A" to this Amendment, requesting that its opening date be deferred until January 1, 2006.
The request was based upon the fact that a facility would not be available until that date.
There are certain provisions in the Charter Agreement that need to be extended based on the deferred opening date. Those provisions are outlined in the Third Amendment.
In the event of any conflict between the terms of the Third Amendment and the Charter Agreement, the terms of the Third Amendment shall control.
The Superintendent is authorized to take administrative action on delayed or deferred openings of Charter Schools.
Financial Impact:
There is no financial impact to the District.
