New Business - Charter Schools

Title: CS8 One (1) Year Renewal Charter for Delray Boynton Academy Charter School

Recommendation:

I recommend that the School Board approve the Renewed Charter Agreement with Delray Boynton Academy which shall become effective upon the signing by both parties, and shall cover a term of one (1) year commencing on July 1, 2005, and ending June 30, 2006 except as otherwise provided in their Charter. 

The parties agree that if the State Board of Education rules that the status of the Charter School is a double "F," that shall constitute ''immediate termination" of the Charter School  as stated in section 1002.33, (8) (d),  Florida Statutes.

Furthermore the School shall full comply with the District's Corrective Action.  Failure to fully comply shall constitute "good cause" for immediate termination.   However, if the School successfully complies with the Corrective Action that may be a basis for a renewal for an additional (4) years.

Description:

The Charter Agreement for Delray Boynton Academy expired on June 30, 2005.  Due to lengthy negotiation issues that extended beyond that date, the Parties mutually agreed to finalize the Renewed Charter Agreement as time allotted.  Based upon the End-of-the-Year Review, the Charter School shall have a Corrective Action Plan.

For FY 2005-2006, the District and the Florida Department of Education will provide technical assistance to Delray Boynton Academy in the development and implementation of the School's Corrective Action Plan which addresses the School's deficient findings in Curriculum and Instruction as documented in the FY 2004-2005 End of the Year Review.

The Renewed Charter Agreement for Delray Boynton Academy Charter School has been submitted and reviewed by the appropriate District staff. 

It shall become effective upon the signing by both parties, and shall cover a term of one (1) year commencing on July 1, 2005, and ending June 30, 2006 except as otherwise provided in their Charter.

Delray Boynton Academy Charter School will continue to serve at-risk middle school students.

Due to the large number of pages, a copy of the Charter is on file in the Board Minutes Office for review.

Financial Impact:
Delray Boynton Academy Charter School will receive 95% of the funded FTE generated by the students.  The District will retain 5% of the FTE as per Florida Statute.
