Title: PD-4 PERSONNEL DISCIPLINARY ACTION

Recommendation:
I recommend that the Board approve Marie Benjamin's Suspension Without Pay, effective August 18, 2005, and Termination, effective fifteen (15) days after the August 17, 2005, Board Meeting, subject only to appeal under Section 120.68, Florida Statutes, unless a timely request for an administrative hearing is made within the fifteen (15) days stated herein pursuant to Section 120.569 and 120.57, Florida Statutes wherein Ms. Benjamin will remain suspended without payment of salary and benefits until final School Board disposition is entered to the administrative hearing proceedings. 

Description: On or about April 26, 2005, Ms. Marie Benjamin was made aware of five (5) areas of Concern: Job Knowledge, Self Motivation, Self Management, Written and /or Oral Assignments, and Punctuality and received an unsatisfactory evaluation, and was placed on a thirty (30) calendar day assistance plan for improvement.
 
On May 26, 2005, pursuant to the due process provisions of Section 120.569, 120.57, 1012.22(1)(f), and 1012.27(5), Florida Statutes.   Ms. Benjamin  was advised of her deficiencies and was placed on an Assistance Plan for Improvement which runs thirty (30) calendar days.  Ms. Benjamin's performance continued to be unsatisfactory.  The Superintendent recommends termination of Ms. Benjamin's employment.

Financial Impact:
There is no financial impact to the school district.
