Title: CS1-Second Amendment Re: Termination of Academy of Creative Education Recommendation:
I recommend that the School Board approve the termination of the agreement for the Academy of Creative Education Charter School effective September 21, 2006, and authorize the Superintendent or designee to sign all related contracts and documents.
Description: The School Board of Palm Beach County, Florida, ("School Board") and the Academy of Creative Education, ("Charter School"), entered into an Agreement on April 20, 2005.
On August 17, 2005, the School Board approved the First Amendment from the Charter School to defer its opening date until August 1, 2006.
On April 18, 2006, the School Board sent written communication requesting the inaugural plans for the Charter School's opening on August 1, 2006.
On August 10, 2006, the School Board received written correspondence from the Charter School informing staff of the intent to reapply to open Academy for Creative Education Charter School in the future because they were unsuccessful in obtaining a facility.
Therefore, in accordance with this Second Amendment, the Charter Agreement shall be terminated “immediately”. The termination will be effective September 21, 2006.
Furthermore, the Charter School shall not appeal this termination but is able to re-apply in the future.
Financial Impact:
There is no financial impact to the District.
