Title: IN3 Workers' Compensation PJ #12749 Recommendation:
I recommend that the School Board approve the Worker's Compensation claim PJ #127479 in the amount of $324,000 representing compensation, attorneys' fees and costs and authorize the execution of all related documents. This settlement will finalize all outstanding issues.
Description: The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.
A now 54 year old Paraprofessional sustained multiple injuries in 1993 after being assaulted by a student. Injuries include bilateral RSD (reflex sympathetic dystrophy), and post traumatic stress syndrome. She was ultimately rendered permanently and totally disabled. The present value of the total future exposure is estimated at $449,037 if not settled.
The District has paid over $398,000 in medical benefits, wage loss and expenses to date. Excess reimbursement is anticipated in accordance with the retention of $350,000. We are expecting excess reimbursement in the amount of $295,000 (medical and indemnity) plus a pro rata share of expenses. The employee's attorney will be paid fees out of the settlement totaling $80,493: a combination of past fees as well as a fee for this lump settlement.
The settlement will extinguish all future liabilities.
Financial Impact:
The financial impact to the District for this settlement is $324,000. The source of funds is the General Fund.
