Title: RE-1 Approve Easement Termination / 03-OOO High School

Recommendation:

I recommend the School Board approve the Easement Termination between Standard Pacific of South Florida and the School Board of Palm Beach County for the 46.68 acre School Site (03-OOO); and authorize the Chairman and the Superintendent to sign all necessary documents.

Description:

·         On May 17, 2006 the School Board approved the acquisition of 46.68 acres for the new 03-OOO High School.

 

·         The previous owner executed a Termination Agreement that released various platted access roads and access easements that benefited the high school site.

 

·         The School Board is bound by the terms of the previous owner’s Termination Agreement.  The property owner to the north has requested, pursuant to the Easement Termination Agreement, that the School Board execute an additional termination agreement to clear title to their property. (See Exhibit I)

 

·         Approval of this Agreement will not impact the access needed for the new 03-OOO High School Campus.  Ingress and egress will be provided from the west side of the property along Lyons Road.
