Title: Recommendation: Description: The outside counsel shall perform the following services: Legal advisor shall provide legal services associated with acquisition by eminent domain of property required for 05-C Elementary School as assigned Legal Advisor by the Chief Legal Counsel from time to time, including but not limited to, preparation and filing of pleadings, attendance at hearings, mediation, trial and appeals. The contract amount is not to exceed $25,000. Earlier on tonight’s School Board Meeting Agenda (Item RE-5), the Board was presented with Resolution No. 09192007RE5 authorizing the use of eminent domain to acquire the property required for new elementary school 05-C. The Resolution also authorized the Chief Counsel to employ outside attorneys if the complexity or workload of the case exceeded the ability of in-house staff to handle it. The Chief Counsel determined that based on the District’s appraisals of the property to be acquired, in the amount of $9,050,000, that the complexity of the case warranted the use of outside counsel. Additionally, it is anticipated that the case will generate additional workload beyond the capacity available through in-house staff. The Chief Counsel selected the Law Firm of Weiss, Serota, Helfman, Pastoriza, Cole & Boniske, P.L. to handle this case. Based upon the estimated budge being provided by Weiss, Serota, Helfman, Pastoriza, Cole & Boniske, P.L. $25,000 is being requested at this time and it is anticipated that this amount will be sufficient to get through an Order of Taking hearing for the property.
