Title: WORKERS’ COMPENSATION CLAIM SETTLEMENT

Description:

  • The settlement of this claim was recommended by the District’s outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits & Risk Management as required by District Policy #6.09.
  • A 62-year-old Custodian sustained injuries to the low back and left thumb on 8/27/98 when she was picking up a heavy trashcan and on 6/22/01 when she was moving a bookcase. She ultimately underwent back surgery after several years of conservative treatment rendering her with sedentary restrictions.
  • The District has paid over $84,000 of its $500,000 retention with a future estimate of over $300,000 to include medical and indemnity.  This includes an anticipated acceptance of permanent and totally disabled status.
  • The settlement has been agreed upon pending Board Approval.  The settlement will extinguish all future liabilities.

 

Recommendation:

I recommend that the School Board approve the settlement of this Workers’ Compensation claim in the amount of $67,500 for EB, Claim Number 137119, representing compensation, attorneys’ fees and costs and authorize the execution of all related documents.  

 

Financial Impact:

$67,500.  The source of funds is the General fund.
