Title: Final Payment for Palm Beach Gardens High

Description:

This project modification contains the following items:

 

Item #1

§         CCD #8 in the amount of $ 45,582.55

§        Description:  Seventy-two (72) day contract extension and extended General Conditions due to the Civil Engineer’s (Metric Engineering, Inc.) failure to get necessary approvals from Seacoast Utility Authority.

§         Cause: Design Omission

§         Justification:  The General Contractor was delayed seventy-two (72) days installing water, sanitary and storm drainage systems while waiting for the engineer to get plan approvals from Seacoast Utility Authority. The District’s Legal Services is pursuing action against Metric Engineering, Inc. for damages.

 

Item #2

§         CCD #9 in the amount of $11,873.00.

§         Description: Site work scope changes and additions:

o       1) Change in slope of the outfield from 1% to .5% at the request of the Palm Beach Gardens High School Baseball Coach.  (Add $3000.00)

o       2) Removal of twenty-five (25) additional trees not accounted for in Contractor’s bid. (Add $5000.00)

o       3) Three additional re-mobilizations by site contractor. (Add $3000.00)

§         Cause:

o       1) The original design called for a slope of 1% from the infield to centerfield fence. This design was based on Indian River CC Baseball Field as agreed upon during early design phase meetings.  Once grading was completed, the coaching staff felt that this grade was too steep and requested that it be re-graded to a 0.5% grade.

o       2) The areas of tree removal were not well defined in the contract documents. Once drainage swale and fencing were located, it was determined that twenty-five (25) additional trees required removal.

o       3) The site contractor had to pull off the project several times due to delays by the Civil Engineer in acquiring Seacoast Utility Authority approvals.

§         Justification:

Item #3

§         CCD # 10 in the credit amount of ($8,132.00).

§         Description:  Returned unused portion of Owner Contingency

§         Cause: School District Requested

§         Justification:  Of the Original $30,000.00 Owner’s Contingency $21,868.00 was used. 

 

Item #4

§         Description: The Project Architect, Fanning Howey Associates, has certified that Palm Beach Gardens High School, under contract with Anderson Moore Construction, achieved Final Completion on October 25, 2004.

 

The General Contractor has requested, and the Architect and Staff have recommended, Final Payment and Final Acceptance.

Recommendation:

I recommend the School Board ratify Project Modifications in the amount of $49,323.55, approve Reduction of Retainage from 10% to 0%, approve Final Payment and ratify Final Acceptance for Palm Beach Gardens High School, New Baseball Field Project, and authorize the Chairman and Superintendent to execute all related contract documents.

 

Financial Impact:

The financial impact to the Project’s Budget is $49,323.55.

 

The source of funds is the project budget as approved by the Board at the time of the Construction Contract Award.
