Title: (YY) - Workers' Compensation Settlement/HL

Description:

 The settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A 66-year-old Food Service Worker sustained injuries to the lower back and left knee when she was injured on 4 occasions between 12/7/01 - 12/22/02 in the line of carrying out her duties.  Her injuries ultimately resulted in permanent and total disability after 2 knee surgeries.

The District has paid over $77,000 in medical benefits, wage loss and expenses.  Present value of the PTD claim is estimated at over $240,000.  The claim can be settled for $95,000.

This settlement has been agreed upon pending Board Approval.  The settlement will extinguish all future liabilities.

Recommendation:
 I recommend that the School Board approve the settlement of the following Workers' Compensation claim in the amount of $95,000 for HL, Claim number 418125, representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Financial Impact:
 The financial net impact to the District for this settlement is $95,000.  The source of funds is the General Fund.
