Title: (ZZ) - Workers' Compensation Settlement/NC

Description:

 The Settlement of this claim was recommended by the District's outside counsel and claim adjusters and has been approved by the Chief Counsel, Chief Financial Officer and Director of Employee Benefits and Risk Management as required by District Policy #6.09.

A 38 year old Police Officer sustained injuries to the  back and right knee when she was injured on 2 occasions both involving the restrain of children in 1995 and 1997.  Her injuries resulted in four surgeries and ultimately resulted in permanent and total disability.

The District has paid over $525,000 in medical benefits, wage loss and expenses.  The case was settled at mediation for $563,000 pending approval by  both the District and the Excess carrier who has agreed.  The net cost to the District after excess recovery will be $100,857.91.

The settlement has been agreed upon pending Board Approval.  The settlement will extinguish all future liabilities.

Recommendation:
  recommend that the School Board approve the settlement of the Workers' Compensation claims of NC, 116715 and 122076, for $563,000 (net $100,857.91 pending excess recovery) representing compensation, attorneys' fees and costs and authorize the execution of all related documents.  This settlement will finalize all outstanding issues.

Financial Impact:
 The financial net impact to the District for this settlement if $100,857.91.  The source of funds is the General Fund.
